These Terms and Conditions ("Terms") govern your access to and use of the website womenonadventures.com (the "Site") and any bookings, inquiries, or services provided by Women on Adventures LLC ("we," "us," "our," or the "Company"). By accessing the Site, contacting us, or making a booking, you agree to be bound by these Terms. If you do not agree, please do not use the Site or engage our services.
Eligibility and Participation
Our journeys are designed exclusively for women. By booking or participating, you confirm that you identify as a woman and are at least 21 years of age. We reserve the right to refuse or cancel any booking if we reasonably believe the participant does not meet this criterion or if participation could affect the safety, comfort, or experience of the group.
All participants are expected to behave respectfully toward other women, our hosts, local communities, and the environments we visit. We maintain a zero-tolerance policy for harassment, discrimination, bullying, or disruptive behavior. In such cases, we may remove a participant from the journey without refund.
Bookings and Confirmation
Bookings are made through direct communication with us (email, phone, or any future booking form). A booking is not confirmed until we send written confirmation and you have paid the required deposit. The deposit is non-refundable except as outlined in our separate Refund Policy.
Upon confirmation, you accept full responsibility for providing accurate personal information, ensuring you meet any entry requirements for the destination (passport validity, visas, vaccinations, etc.), and obtaining appropriate travel insurance.
Payments
Payment terms are specified in your booking confirmation. Failure to pay the balance by the due date may result in cancellation of your booking without refund of amounts already paid. We accept major credit cards and other methods as communicated at the time of booking. All prices are in United States Dollars (USD) unless otherwise stated.
Changes to Journeys
We plan every detail with care, but travel involves variables beyond our control. We reserve the right to make reasonable changes to itineraries, accommodations, transportation, or other elements if necessary due to weather, supplier issues, safety concerns, or other unforeseen circumstances. If a change is significant (substantially alters the nature of the experience), we will notify you as soon as possible and offer options including accepting the change, transferring to a comparable future journey (subject to availability), or receiving a refund for the affected portion.
Minor changes (such as small timing adjustments or substitutions of similar quality) do not entitle you to a refund or credit.
Liability and Disclaimers
We act only as an organizer and facilitator. We do not own or operate hotels, transportation providers, local guides, or other suppliers. These third parties are independent contractors, and we are not liable for their acts or omissions.
To the fullest extent permitted by law, Women on Adventures LLC disclaims all warranties, express or implied, regarding the journeys, including but not limited to fitness for a particular purpose or uninterrupted enjoyment.
We are not responsible for personal injury, illness, death, property damage, loss, delay, or inconvenience arising from:
- Your own actions or negligence
- Third-party suppliers
- Force majeure events (natural disasters, war, terrorism, pandemics, government actions, strikes, etc.)
- Your failure to comply with entry requirements, health protocols, or local laws
- Personal belongings left unattended
You participate at your own risk. We strongly advise comprehensive travel insurance covering cancellation, medical emergencies, evacuation, and personal effects.
Your Responsibilities
You agree to:
- Comply with all applicable laws and customs of the destinations
- Follow reasonable instructions from our hosts and local guides
- Inform us in advance of any medical conditions, dietary needs, mobility limitations, or other requirements that may affect your participation or the group
- Not engage in illegal activities or behavior that could endanger yourself or others
Intellectual Property
All content on the Site, including text, photos, designs, and logos, is owned by Women on Adventures LLC or licensed to us. You may not reproduce, distribute, or use any content for commercial purposes without our written permission.
Limitation of Liability
To the maximum extent permitted by law, our total liability to you for any claim arising from or related to these Terms or our services shall not exceed the amount you paid us for the relevant journey.
We are not liable for any indirect, incidental, consequential, special, or punitive damages, including loss of enjoyment, emotional distress, lost profits, or data.
Indemnification
You agree to indemnify and hold harmless Women on Adventures LLC, its owners, employees, agents, and affiliates from any claims, losses, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from your breach of these Terms, your participation in any journey, or your violation of any law or third-party rights.
Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes arising from these Terms or our services shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida.
You agree to first attempt informal resolution by contacting us before pursuing any legal action.
Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, Refund Policy, and Cookies Policy (all incorporated by reference), constitute the entire agreement between you and Women on Adventures LLC regarding the Site and our services.
